Delaying in submitting chargesheet it has been more than 90 days

I had file a FIR against a man under section 376 and 509 as on 11/5/2022 now it has been completed more than 90 days I asked io about my chargesheet she replied me that I'll submit chargesheet on 17 aug and on 17th aug she replied me that judge asking for e challan only with e challan my chargesheet would be accepted in court i had submitted some screenshots and voice recording in CD drive with transcript as a proof on 11 June now io is not giving me the clear answer about the chargesheet and she also confirmed me that she also add one section as well in chargesheet that is 328 . My question is what is e challan and what does it require for and why is she delaying to submit.

The charge sheet should have been filed by now. In case there is a delay, you can move an application before the magistrate seeking a ATR from the investigation. Once the same is filed you’ll need to press for the charges to be framed. Feel free to get in touch to discuss further.

what is your issue? e- challan is a soft copy of challan filed in PDF file on particular court site. Courts are encouraging working on computer and to discourage papers. duch delay is caused as police personal are over burdened. As such there is no suspicion merely because challan could not be filed within 90 days.

This is the internal process of the police department …so you do not have to do anything in this…. if the chargesheet is not filed you can simply find an application in the concerned court regarding the status of your case .. this is the only thing you can do at this stage thank you
