Criminal Case Against builder after payment not delivered Project

I have invested in a commercial space and paid the money in cash and cheque. The cash was paid through the authorised dealer from whom i took receipt. I want to file criminal case in 156(3) CrPC. Is there any harm if i show that payment was made through cash and cheque.

Respected sir you stated that you are invested in a commercial property .if the builder chit you can file recovery suit and also file a criminal complaint against the builder . you can call me thereafter I give you proper advise to you.

First you need to file a complaint with the SHO and other authorities. One cannot file 156(3) directly in the concerned court without filing a complaint with the concerned authorities. Secondly, whenever you must have made the payment you must have been given an acknowledgement by the builder/dealer against the same and we should file that receipts.

yes you can proceed against builder and agent as well in criminal proceedings even though payments are made in Cash transactions. i will also recommend to proceed RERA simaltanously against the builder for refund along with interest or possession whatever suits you.
