Criminal activity but not appearing in divorce case hearing

18-Feb-2023 (In Criminal Law)
I have few cases against my husband and it’s been two years divorce case is going on but he never come to attend the hearing. Judge made him as a ex partie but from the past two months his brother and relatives are chasing and threatening me. Today again the same thing happened with me , when I was going to bank for my dad work . He saw me on the way and he started threatening me and told me that I should take back the case otherwise we will kill you /burn you. It’s very scary experience. I went to police station and written complaint against him. But I know they will not do anything thing against my complaint. Today I come to know my IO also has been changed but police officers didn’t give any information about him. Now it becomes serious. What should I do? How will I get relief from him and alimony too. Since I am a patient also. I got anxiety attacks frequently and then I failed to do anything in such situations.

Dear client You should file a complaint under section 200 before the magistrate. If the police are not lodging an FIR. You need to directly approach the magistrate either with a private complaint or under section 156(3). Feel free to get in touch for further discussion

1. if the police does not register and FIR you can approach the court by filing a private criminal complaint under section 200 CRPC against your husband and his relatives. 2. also file an application for directions to the police to register an FIR under section 156(3). 3. you must also seek police protection. feel free to contact me incase of any further queries
