Compensation for injury at the site of a wedding reception

22-Dec-2024 (In Criminal Law)
I was at a wedding reception at an outdoor lawn (inside private property). A huge tree used as center piece (with lighting, sound equipment etc on it) toppled over our table and landed on my foot. Three surgeries later, one big toe had to be amputated. Can I claim compensation from the management of the facility for my injuries plus mental stress/agony, permanent disability. There was no wind, rain or any other natural calamity for the tree to fall on me.

Dear Sir, It is a fit case to claim huge compensation either in the civil Court or in the Consumer Court. You are advise to collect CCTV footage about the falling of tree and also collect all the relevant medical records to show that you have an permanent disability accordingly you may get issue a legal notice thereafter initiate cases for getting huge compensation.

yes you can file a criminal case for negligence and also a civil case for compensation against the hotel as it was their duty to see that the tree is intact and it does not cause loss of life and limb and as they are providing services the person who hired the hotel can also file a consumer complaint for defiency in service.
