Collusive Partition Suit And Prelim Degree Without My Knowledge

How to stop the preliminery decree which was obtained without my knowledge . Can we file criminal petition. Iam the 80 % uds share owner and balance 20% uds share owner is playing

Merely because the, plaintiff does not choose to implead a person is not sufficient for rejection of an application for being impleaded. The provisions of Order 1 Rule 10(2) C.P.C., are very wide and the powers of the court are equally extensive. ... are two types of persons who may be added as party to the suit.

get the case details of which the partition suit is filed partition suit the preliminary decree will be passed information in which court and what is the case number what is the present position of the case that you must file and include petition to include yourself in the above case

you can file a written statement and the vacate the preliminary decree and challenge the same with the concerned court. If the Court convince with your answer then at the time of final decree it will cancel the said preliminary decree.
