Closure report filling without accused statement

Can closure report be filled without accused statement or arrest , if evidence against him is not found ? Or they need statement and then they can file closure report ???
Closure report is submitted by the police to the Magistrate stating that after the due investigation against the accused, no evidence for suspicion are found to the alleged crime. And if the accused is in custody, he shall be released on certain conditions like executing a bond.

Well it depends whether the cases summary trial or what it's a warrant case the statement of accused under section 303 is recorded by the magistrate so deep I don't know what is the stage of the case for more detail You come to our office
