Clarity on NOC requirement for fresh appeal

We hired a lawyer for bail application and gave the vakalatnama. After a lot of delay and no responses from the lawyer, it got listed and we received the bail order that stated it has been withdrawn. So current application has been dismissed with liberty to file fresh. We want to hire a different lawyer for the fresh appeal. The lawyer says that we need NOC from him to file the fresh application later with other lawyer? My understanding is as the application stands dismissed, the new application will need new vakalatnama and we can hire a new lawyer without NOC. Need clarity on this.

if you are filling fresh application then you don't need NOC from previous lawyer.

This is really unfortunate. Lawyers should desist from such practices.

You are right in your assessment. You don't have to get a NOC from the earlier Advocate.

But please note that you will be filing another Bail Application and not an appeal.
