Clarification on report not being submitted by SP police in court
08-Jan-2023 (In Criminal Law)
Police has filed case to Cort. But SP police does not submitting his report till three month .Dose it effect my case.
pls clarify what report the SP is required to submit. If you are referring to chargesheet/Final Form/Police Report then delay on part of the police in submitting the same gives you a very good ground for seeking bail if not already sought for.
Dear Sir
If one has been arrested and charge-sheet has not been filed within 90 days, the person so detained is entitled for his release on bail in case the offence alleged is punishable for atleast 10 years' imprisonment. If one has not been arrested and charge-sheet has not been so filed, the only effect of the same would be that speedy justice is denied to both the victim as well as to the accused.

Yes, it does affect. Delay affects both the parties. Contact the SP and request him to expedite the submission. Also, you can approach the Court including High Court for speedy submission of report too.
