Cheating issue by providing Car Leasing
14-Jul-2026 (In Criminal Law)
In August -2025 I took a car on lease from a party and gave 85000 to them. we prepared a 6 month agreement and still now they didnt give my money back. Shall I Eligible for giving a complaint against them ?
Yes. since the 6-month lease period is over and the party hasn't refunded the ₹85,000 (whether it was a security deposit or advance under the lease agreement), you're entitled to recover it: first send a legal notice demanding refund within 15 days citing the lease agreement and the expired term, and if there's no response, you can file a civil suit for recovery of money before the appropriate Munsiff Court based on the pecuniary jurisdiction and the place where the agreement was executed or the amount was paid — additionally, if there's an element of dishonest intention from the start (i.e., they never intended to return the deposit), you could also explore a criminal complaint for cheating/breach of trust under the BNS, though the civil recovery suit is the more direct and reliable remedy here.
