MY MOTHER,73 YEARS OLD, IS A RECORDED OWNER BY SALE DEED OF A HOUSE. AGAINST HER WISHES MY YOUNGER BROTHER DO AN NOTARIAL RENT AGREEMENT WITH ENGLISH WINE LICENSEE FOR SELLING ENGLISH WINE IN A SHOP OF HER HOUSE.AND FILE CIVIL SUIT FOR PARTITION OF THE HOUSE WRONGFULLY CLAIMING HIS ANCESTRAL PROPERTY TO COVER UP HIS RENT AGREEMENT.MY MOTHER REGISTERED A F.I.R.AGAINST HIM U/S 419,420,467.468,471,504,506 OF IPC AND POLICE HAS CHARGESHEETED HIM.CAN HE STAYED THE PROCEEDING OF TRIAL IN HIGH COURT OR SESSION COURT.

as it's a matter of son and mother it can be sorted out in mediation center in 420 is clear as she is senior citizen she can or you can also sort this matter out of the court by a mutual agreement do consult an advocate with your papers if it is not possible.

dear client in that case will charge sheet has been filed by the IO before Court then opposite party m a y approach High Court for stay under section 482 CRPC better engage Council before High Court who m a y watch your matter when it will come before High Court for more clarity you may contact us advocate Anurag Bhatt Allahabad High Court
