Chargesheet Quashing in Bombay high court
24-Dec-2024 (In Criminal Law)
Hello Respected Lawyers,
I have charges under POSCO act section 8. Chargesheet has been submitted in session court. My lawyer has suggested me for Quashing the charge sheet in Bombay high court. Can you suggest is this right way and what will expense for this.
Also if I file application for discharge, how much time it will take and what are the expense of that?
Can you please guide me.
For Quashing the Chargesheet under Section 482 CrPC in the Bombay High Court, you need strong legal grounds such as lack of prima facie evidence or flaws in the investigation, this process may also take some time. For filing an Application for Discharge under Section 239 CrPC in the Sessions Court, the focus is on insufficient evidence to proceed with the trial. This process is generally faster. Fees may vary.
you can go for discharge we can go for what is a question but 10 cases like poxo where the allegation straight forward straight forward I mean there is fees leveling an allegation so ine Sach cases the chances of discharge causing a very rare because for the centre reason the allegations are direct Raj and causing Prima faces the fire is required to be seen not your merits what is the fact what is not the fact not your merits
