Chargesheet filing and status monitoring by the court

I had filed a fir in EOW against a builder. Since 2 years no chargesheet has been filed by IO. How and under which sections of IPC can i ask the court to instruct IO for filing of chargesheet . Can the court also monitor the progress of investigation , if so then how?

If you have given your evidence under section 91 CrPC to the IO and even if he's not doing anything then it clearly means that he might be bribed by the opposite party. The matter will only be operational in the court if the chargesheet is filed in the court. If there is any pending money involved in your case then it's advisable to file a recovery suit in the court to claim your amount along with compensation. Okay I understand your query regarding your case which already filed by in concerned police station and when the IO has not taken action properly and not filed a chargesheet before court within stipulated period of time then you have file an application 156 of IPC for monitoring of FIR before cour alongwith Status report of investigation

yes you can file monitoring FIR through Court and also file a application from submission of charge sheet and file RTI why this type of delay not file after 2 year your report this suggestion is given by advocate Amarjeet Kumar chamber in Supreme Court and Hazari

complaint can be filed under section 156(3) crpc in the court of magistrate seeking directions for registration of FIR against the builder.
an application can also be made to the magistrate for monitoring the investigation.

You may file a protest petition before the court which is seized with matter seeking status report but generally these EOW’s do not easily succumb to trial courts. So the best alternative in my opinion would be to approach the HC and pray for direction for time bound filing of the Chargesheet as well as to appraise the court and also you as to progress of investigation so far.
