Charged exorbitant fine after accusing person of shoplifting

05-Jan-2024 (In Criminal Law)
A person involved was accused of shoplifting candy worth ₹270 from a company hypermart. The owner/manager demanded ₹10,000 first. On refusal, reduced the demand to ₹5000. On repeated refusal, made the party’s family pay ₹2700 + the price of the candy. Is it legal to demand ₹2700 extra as fine for ₹270 worth of product? The person did not go away with the product and had agreed to pay the normal product price when asked.

Dear Sir, Offence of theft is punishable under Section 379 of IPC but there is no leniency for theft of small article or big article. As such without registering an FIR and without undergoing trial before the Court it was appropriate for the shopkeeper to direct the culprit to pay a fine of Rs. Two thousand seven hundred only having stolen a candy worth of Rs. Two hundred and seventy only.
