Chances of getting falsely prosecuted by wife u/s 498A

I m sister in law. My parents, brother and me, we all fear that she might send us into jail just to pacify her mind and take out personal enmity. She has no affection with anyone of us and it has been 4 yrs of their marriage. We feel scared and she has started to torture us. How can i protect my brother, parents and myself from going out jail. Obviously in trial, we will prove the case, but the practice is that police arrests initially only. So how do i protect from such intentional act

Hi,if you have an intention that a FIR is being registered against you or your family members,you can approach court and file for anticipatory bail ..Once anticipatory bail is granted ,the police cannot arrest you ..

Hello if there is apprehension of arrest and any complaint is filed before police or court you can apply for anticipatory bail. If there is no police complaint or complaint to court you should try to resolve the matter amicably. In such situation your brother can also think about filing petition for divorce in the Family Court

Start by living separately with your mom and dad, let your brother and his wife stay separately, that's the basic safety option for protecting yourself and your family from unnecessary issues. Later on, for your brother, tell him to consult an Advocate for proper guidance by meeting him/her up.
