CHALLENGE IN HIGH COURT FOR BAIL CANCELLATION

06-May-2024 (In Criminal Law)
we are currently fighting a case in district court, one of the accused who was on bail had left the country for couple of months without court's permission and violates bail conditions but the district court judge didn't cancel the bail and asked the accused to return back. The accused had returned but we wanted his bail to be cancelled. Could we challenge this in High court?

Certainly, there is no bar. However, the Court has the discretion to decide whether to cancel the bail or not, as the sessions court has already done in your case. The only question that remains is whether the sessions court has made any serious error or acted illegally.
