Challan for Drunk Driving in Gurgaon, Will I get jail time?

26-Feb-2025 (In Criminal Law)
I got caught at a nakka in Gurgaon, the BAC reading was 101 and this is my first offence. Can I be jailed under this? How long will it take to get out of this? Will i have to wait for 3 months to get a court date or it can be done immediately? Will they inform my employer?

You will have to pay the fine in court only. Make sure you visit during the national lok adalat day. First fine might cost 5k-10k. They won’t inform employer. It would also be okay if you wish to get this done at the earliest to stay relieved from unwanted tension.

Since your BAC (Blood Alcohol Content) is 101 mg/100 ml, which is above the legal limit, it is considered a serious traffic violation under Section 185 of the Motor Vehicles Act, 1988. Can you be jailed? Yes, for a first offense, the punishment may be up to 6 months in jail and/or a fine of up to ₹10,000. However, in most cases, courts impose a fine instead of jail for first-time offenders. How long will it take? If you pay the fine, the matter can be settled quickly. If the case goes to court, the time depends on the court's schedule, but you may not have to wait 3 months for a hearing. Will they inform your employer? Usually, traffic offenses are not reported to employers unless required by law or if your job involves driving. Adv. Mahinder Singh Mavi

No, you will not get jailed. you only will have to pay the fine as decided by the Court. To remove the challan, you have to wait for 3 months after paying the fine . Since this is a minor offence, no jail can be granted.
