Case using the complaint registered at the police station in bangalore

26-Jun-2023 (In Criminal Law)
Am from Bangalore, on a cheating case I have filed a complaint in police station in another city, and I have received the Acknowledgement 76A from the police. The police there is yet to get back on the progress of the complaint, which might take one week from today, that is after 15 days from the date of complaint. Could I know if with that acknowledgement, can I file a Criminal Case from Bangalore, as it is taking more time than expected, as am residing in Bangalore?

Sir, Ack. 76A will be given for complaint on non cognizable offence . After investigation by the police, If police find the complaint is cognizable offence then they will be registering a FIR based on the inquiry. FYI. IPC 420 is cognizable offence. so, You need to approach jurisdictional court to get direction to police to file FIR u/s IPC 420 . You need to talk to a lawyer on this.

Hi,

You may not file the same complaint again in B'lore only on the ground that there is a delay which may lead to multiplicity of cases. The option which is available to you, if you want to file the complaint in B'lore is to make out fresh grounds and then file complaint.
