Can police arrest if we have not taken dowry

Hindus. Brother married recently. She stayed for 10 days out of 2 months with husband. After marriage she found to be mentally immature. Informed her parents. They fought with us. Hence sent notice through advocate for divorce. V r Scared they may giv dowry complaint bcoz law is in favour of girls. V havnt taken any dowry. Our lawyer telling as we havnt taken dowry no need of anticipatory bail n will file for divorce after 15 days. But v dont know law. V r scared abt police arrest.

Yes your lawyer is correct, if they file complaint then you can file for anticipatory bail, further they may at most file restitution of conjugal rights case or maintenance or domestic violence case where you only have to appear and defend the case, further as per the supreme court directions the police cannot arrest you directly without following the procedure, hence there is no need to worry as such. If complaint is filed then apply for anticipatory bail.

Hi, It is quite weird that you did not know her immature before the marriage. Before you say somebody mentally immature then you should have medical proof from the RMP. FYI. law does not favor anybody whether it is male or female. Dowry harassment complaint can be filed even if divorce case is in pending status. So,If you think that your brother could be arrested by the police then it is better to apply for anticipatory bail. perhaps, your current lawyer may not aware on these things which may lead you into troubles in upcoming days.
