Can judgement debtor file defamation on decree holder.

In 2008 , my father purchased land in our village in Chitoor dist AP and registred in my name.neighbour land is govt poramboku. At that time i was working in BHEL at Nasik MH. After my father expired no one is there to look that land. Near by land owner ( he claims but it is in other name) filled false case against me that i was interfering in his property . Knowingly mentinoed address at village and noticess are not served to me as no body there in the village and got decree in 2015. I dont know about the case . Now recently i got transfered to Ranipet TN which is nearer to that said place. Knowing that i came here again he filles EP case on me. He demand was hande over my land to him and pay some amount for court fees etc. The EP case is running now. Im contesting the case . Now is it possible file defamation indicating the above on decree holder.

Dear Sir,

I have gone thru your query. At this stage you have to defend him by filing your version in E.P. and try to produce all the supportive Revenue records like, ROR, Adangals, ROR 1 A and 1 B, Village Account No.2 & 3 (Grama Leila 2 & 3) from the concerned MRO Office.
And also submit your Link documents I.e. how did you acquired that Land etc.
At this stage you cannot file Defamation case against him as it is a Court Order.

It's not the case to file for defamation.. and mere filing of civil suit does not attract the provisions of defamation.. moreover it is hard to prove our case.. the immediate step you have to take is to file a decree set aside petition and also file a petition for stay of EP proceedings. So that you can contest your case and prove your case if your father is having valid title over the property. It will definitely be in you r favour
