Questions Answered by Advocate V Sreenivasa Rao

Q: What to do when a girl mentally harasses me

Sir, I spoke to a girl from March 5th to March 17th 2018. Our initial conversation was regarding work life and other basic things. Later we started talking about our likes and dislikes further moved to sharing love you messages which was not from heart but it was just casually. One day we went to a tourist place in bike where I kissed her forehead and cheek and she kissed my forehead and nothing more sexual happened. While returning back she asked me if I can marry her, I said No I cannot and that is not possible. My family situation is not good and they will never agree for love marriage, I already informed her the same before we went out. I never ever committed that I will marry her. After I said no she started telling I will commit suicide or I will give police complaint. For even small things she is torturing that she will commit suicide if we don't get married. She is very adamant and stubborn. From the beginning am telling that I don't want to marry her and I didn't giv false hop

Advocate V Sreenivasa Rao answered
Hi,You did not mention your ages in your query whether both of you attained majority. Even otherwise try to collect some evidence on your part and try approaching police authorities in advance claiming the blackmail nature of the girl. Knowing her attitude well in advance why that you entertained her taking her on your bike..? It shows your intentions are also going in a wrong direction some where. If you are sure that, you informed her well in advance about your family situation and your position in writing then take those evidences and take the help of some elderly people and explain the situation to her parents and if possible record it. If they are not agreeing for your requests then take a appropriate action with the help of a legal consultant.BR

Advocate V Sreenivasa Rao answered
Hi,You can approach court asking your baby by filing custody petition. You did not mention the age of the boy, if the boy has crossed 8 or more years you certainly approach the court. Coming to you Mothers property, as it is self acquired property, your wife cannot claim any share in that. You Mother can take a decision out of her own choice.BR,

Q: Advice in case girl filed case of cyber crime

Sir, I am accused of stalking by a girl. I sent some mails to her conveying my love on her but she felt the other way. She approached police. They checked the mails. And felt since there is no abuse, tell her sorry and write a sorry and undertaking letter and hand over it to her for her future security. I did it and never never mailed her back. This happened on may 9 2018. But two days before from now, police called me again to come as I insulted her in my WhatsApp status that day. I told them it's my phone and I have right to express my pain and anger. But didn't disturb her. But police are not listening. How can I defend myself. Can't I express anger on my phone device. What's their right to question my WhatsApp status!??.

Advocate V Sreenivasa Rao answered
Hi,The details mentioned in your query are not elaborate to understand the actual nexus of your problem. If you strongly feel that, you did not mean in having your WhatsApp status is intending to insult her, then take 41 - A Notice from police and give your explanation what you mean exactly. Then it will serve most of your problem. If police at the station level are not convinced with your explanation, approach senior officials and try to explain them the situation, they will consider it.Best Regards,

Q: Security cheque dishonored what to do

My firm give security blank chaque issue eyar 2013...company present this chaque in year feb-2018.chaque dishounar . Then company file case dishounar chaque. court shaman to me.

Advocate V Sreenivasa Rao answered
Hi,You did not share the full details of your case. Before getting Summons from the Court you would have got Legal Notice Issued by the Complainant, in reply to that Legal Notice you would have answered all the facts about the transaction. Thereby, you have missed an opportunity. No issues, now you can attend before the court and explain all the facts, if you have track of the cheques issued by you in your cheque book. Take a xerox copy of that transaction page and present it before the court. If it is of a old cheque, collect some evidenciary proof from your Banker and produce before the court.Best Regards

Hi,Take your parents to girls house and try to explain the situation in a better manner that, how you are a better person as a life partner to her parents. You did not mention about your age now. If both of you are majors and have confidence on each other and more over confidence on yourself that, you will get settled soon in your life and look after her well.Br
