Can I re-open DV case against my husbanthat I withdrew husband earlier
20-Mar-2023 (In Criminal Law)
Sir/madam, already I put cases on my husband (domestic violence). He made me to come back to home and made to withdraw the cases. But his behaviour and the way he is treating me and kids is worst now. Do those cases have enough strength to fight with him once I run that same cases?
Mam, you can file fresh complaint under DV Act. There is no embargo for filing second complaint under the said Act.
But ln the second complaint you have to narrate as what was the reason for withering the First one. It better to file the certified copy of the order sheet of first case.
Peruse for legal remedy. God Bless You.

Hi, The DV cases are non-compoundable offence by the court. I have no idea that you were given opportunity to withdraw. I would able to advice you on reopening the case only after seeing existing case details. However, If you have enough evidence against your husband you can file fresh case. I would like to know whether you filed any divorce case?
Yes Madam you can file the new case immediately. It is a very beneficial legislation for the people like you who suffer at the hands of violators. The previous case history will also strengthen your position and can evoke stringent action against your husband
