Can I get maintenance from my father

04-Jun-2023 (In Criminal Law)
Hello Sir , I am 22 years old now so can I claim maintenance or educational expenses from my father ? Is it possible according to law ? My mother is still getting maintenance from my father according to court order even I was also getting maintenance from my father till my 17 years age but later, my father suddenly stopped only my maintenance even I prayed to the ld.court in this regard but the court rejected my plea & court said I'm crossed 17 years age so I'm not entitled to get maintenance from my father but still I'm a college student but my mother is not able to pay my college fees or educational expenses even I have no source of income & my mother fully depend on my father's maintenance & as a result, my study can be stopped forever . Sir, please give me some advice what will I do? If have any higher courts judgments where the 17 years age completed son entitled to get maintenance from his father so please inform me as soon as possible please please. Thank You .

Yes there are judgements to the effect as well as you can claim maintenance from your father even if you have attained adulthood. Your father has to maintain you without a choice. I hope you are well guided by your lawyer

The answer of your question is no. Your present age is 22. You have already attain the age of majority and therefore you are not entitled to get maintenance under Section 125 of Cr.P.C which you previously availed. Age of Majority is 18, not 17. If, your father stopped to give you maintenance at your 17 years of age then you can claim only 12 months arrears. Then you have to file an Execution case before the same court from where you got maintenance.

Yes, you are entitled to get maintenance from your father till you get married and definitely according to law . There are so many references. So it is better to take advice from an advocate who can guide you to proceed further.
