Can I file an ongoing complaint with police under Section 156 (3)?

Hello, I had filed a police complaint of Fraud committed against me, It has been 14 months since I last filed this complaint. My investigating officer is now since 2 months saying that the file has been sent to the law department to further assess whether the crime committed comes under Civil or a Criminal case can be filed. I want to know whether I can file this ongoing case under Section 156 (3). If I can file this case, what will be the procedure? Do I have to pay any fees to the magistrate? Normally, how much time does it take to file this case? Kindly guide. Thanks in advance.

As you said, you have filed a complaint before police station and it is under investigation and not yet been decided. You now got to write your complaint to the Superintendent of police and then you may file complaint under 156(3).It is advisable to take help of advocate for drafting.

Yes, you can file this case as Private Criminal Complaint under Sec 156 (3) of the Criminal Procedure Code. It will not be worthy if you shall wait more to get the FIR registered. It'll hardly take 15 Days to get your case on board.

please take a note Magistrate don't take fees only advocate are taking the fees and some one telling to you that there is fees for Magistrate so he is fraud the law rato is the best online portal to get help so contact ours call center and post question in detail Thanks
