Can I File a Consumer Case Against Payment Aggregator (WEIPL) Despite

11-Jul-2025 (In Criminal Law)
Can I file a consumer case against payment aggregator WEIPL for failed invoice discounting transaction, despite its ongoing commercial suit in Bombay High Court, since I suffered financial loss due to lack of service and chargeback denial? Does the High Court case prevent me from seeking consumer relief independently under the Consumer Protection Act?

Yes, you can file a consumer case under the Consumer Protection Act if you suffered loss due to deficiency in service by WEIPL. The Bombay High Court commercial suit doesn't bar you from filing a separate consumer complaint unless the issues are identical and already being tried. If your claim is personal and based on poor service, you can proceed independently.

Yes, you can file a consumer complaint under the Consumer Protection Act, 2019 against the payment aggregator WEIPL for deficiency in service and unfair trade practices, despite the pendency of a commercial suit in the Bombay High Court. The existence of a civil or commercial proceeding does not bar a consumer from approaching the Consumer Commission, provided your grievance relates to service failure, denial of chargeback, and resultant financial loss suffered in a personal capacity as a consumer. However, the maintainability of the consumer complaint may be challenged by the opposite party on grounds of parallel proceedings. To safeguard your rights, disclose the pending High Court matter in your consumer petition and clarify that your relief sought is personal, limited to consumer protection grounds, and not overlapping with commercial adjudication.
