In 2015 my father in law sent me a defamation notice accusing me of dat I put derrogatory remarks against him and family in face book and he sought 25 lacs. I gave strong reply inturn seeking one crore. But he didn't file defamation in the court. Now can I inturn file a case against him for sending false notice and harassing me. Your father in law gave notice for your derogatory remarks against him. If any such defamatory words by him against you you also certainly file defamation suit against them who caused for it for an appropriate amount

Hi
you can file a defamation suit against your father in law, if he has made any derogatory comments on you.
Mere sending of legal notice by your father in law will not tantamount to defamation.
The essentials of defamation are
a) the comments made by your father in law should be false and
b) the comments are made to malign you, character and conduct and
c) the comments should have made by your father in law in public (atleast 2 ,3 people should have heard your father in law making the comment and
d) the comments should have caused irreparable losses to you.
Hope this information is useful.
