The police station in charge has no power to grant bail to the accused under IPC 379 section (theft). However, they can serve a notice to the accused under Section 41(a) CrPC and submit the charge sheet to the court without making an arrest.

No, the police cannot grant bail in cases related to 379 IPC. The offence under IPC 379 section is non-bailable and cognizable, meaning only the court has the authority to grant or reject bail to the accused.

Dear Client, no, the police in charge at the thana has no power to grant bail. Only the court has the authority to grant bail upon petition, and the decision may depend on the details of the FIR. You may contact a lawyer for further legal assistance.

Section 379 IPC is a cognizable and non-bailable offence. In such cases, the police do not have the power to grant bail to a person accused of theft under IPC 379 section. If an accused wants bail, they may apply for anticipatory bail before the appropriate court.
