Bike recovered after owner's death

29-Jul-2023 (In Criminal Law)
Hi, The bike which was in my dad's name was stolen and recently recovered. However, my dad passed away during this time. Now the lawyer is saying we need to get the vehicle transferred to my mother's name to get the bike released. Is there a possibility to release the bike as is and then transfer it my mother's name. Since we have property related issue at home and the other legal heir(i.e. my brother) apart from me and my mother is not willing to sign for transfer of motorcycle.

Dear Sir, It all depends upon convincing the Magistrate since there are many legal heirs to the deceased as such you have to take NOC from other members of the family to get lease the vehicle either in your name or in the name of your mother. Actually, it will be released only to the RC owner.
