bail under sec 7 pca from high court


31-May-2023 (In Criminal Law)
>father booked under section 7 PCA (demanding bribe).>complainant used 2 year old video as evidence.>NO recovery of money (red handed or during house raid).>moved bail application in sessions court after 25 days.>bail dismissed.>moved to high court.>judge gave date after 2 months,waiting for charge sheet to be submitted (90 days period)nquestion - is the any possibility of judge dismissing our bail application without even hearing our advocate?

Why do you think that judge would dismiss your bail and that too without hearing your advocate? Let chargesheet be filed. Keep yourself positive and ask your lawyer to bring your case in better footing. Demand acceptance n recovery are major pillars and even if a single one is missing then bail is there for sure.

hi, Judge is waiting for complainant evidence to be conducted in the court. however if yhe circumstances as stated above the bail can be granted. bail application is on the discretion of the justice after applying his judicial mind possibilities are there..
