Bail Prospects in PC Act Trap Case with Recovery from Co-Accused

03-Mar-2026 (In Criminal Law)
A government forensic doctor has been arrested in an ACB trap case under the Prevention of Corruption Act and sent to 14 days judicial remand. Allegation: bribe for postmortem report. Money recovered from a constable (co-accused), not from doctor. ACB claims audio recording exists. What are bail chances in such cases? How much weight does audio carry at first hearing? Does judicial remand improve prospects? Seeking practical guidance.

Firstly the audio recording and its credibility is a matter for the trial court to decide and appreciate it in evidence during the trial. There are procedures laid down in law regarding that .If the chargesheet has been filled and prima facie there is no evidence of the doctor been involved and particularly of the recovery then there is possibility of getting bail. Contact for any help.

Good chances of bail. As you have been implicated on the basis of memorandum of the co-accused. No demand, No recovery established from you. Move a regular bail application under section 483 BNS before the District Court.

their are chances for bail but the statements and whole trap should be examined and discrepancies should be pointed out before the special judge . look for necessary elements of corruption such as demand for bribe , receiving of bribe etc
