Bail in case of charge under IPC 406

27-May-2023 (In Criminal Law)
I work in a private tire manufacturing company. My company gives a discount of 5% to retailers if they give payment within 30 days of delivery of goods. But some retailers gave payment beyond 30 days and still paid to the company availing the 5% discount. Thus this amount is now outstanding in the balance sheet. As a branch manager I had the responsibility of clearing the outstanding. Retailers have not cleared the outstanding , so my company has filed case against me under section 406 of IPC

as a thumb rule it is advisable to first approach the district court for anticipatory bail. if it fails then you can approach the high court. the letter of complaint will be relevant as also the quantum of money allegedly misappropriated by you and the company version of it. if you have any documentary proof of your innocence then it would be helpful both for bail and quashing. thanks & regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court, Calcutta.
