Authority gives two different statements in the same case

Respected All, In a registered criminal case IPC 420,467,468,471 of a POST OFFICE against a employee- 1- Charge sheet given to concern employee by post office says that employee left the office at 2.30 afternoon/daytime? 2- In his statement to court, same authority i.e.post office says employee left office at 3.30 daytime? Which point 1 or 2 should be true, valid, and acceptable in court? Who will get benefit of two different thought at a time and how? What must be the final decision according to legal Indian laws? Always Thanks.

The case was registered for cheating. The vitality of evidence is important. If 161 statement differs it can be proved by cross examination of evidence. The court can be brought about this. The cross is important.

The timing stated in the Court has much more validity since the FIR and Charge sheet is framed by the police authorities based on the Complaint lodged and there is a change of misleading the same. The timing difference can be elicited in the cross examination and the Court has the power to decide which is the correct timing based on other evidences putforth.
