Attempt to murder and captured video

a gang commited attempt to murder on a muslim young person in 2014. the victim complainted to police. but the police not registered case on the gang and also police did gundagiri on that victim. victim left the p[olice station for save his life. now he can give complaint to police again ?

victim filed private complaint againt the gang and police officers before first class magistrate. And apply the sanction order before police higher authorities for prosecute the police officials to proceed the complaint.

1) Section 468 of the Criminal Procedure Code, defines the period of limitation.
2) The period of limitation shall be-
- six months, if the offence is punishable with fine only;
- one year, if the offence is punishable with imprisonment for a term not exceeding one year;
- three years, if the offence is punishable with imprisonment for a term exceeding one year but not exceeding three years.
3) You have used the word attempt to murder(sec307). If the person died as a result of attack, it is attempt to murder.
4) the person received grevious injuries then for voluntarily causing grievous hurt imprisonment upto 7 years and fine (Section 325 ). So limitation period is 3 years.

Hello,

Yes the police has to register an FIR basing on the complaint of the complainant. If the police is refusing to register an FIR, write to SP and ask him to direct the concerned police official to register an FIR. If despite this nothing happens, the complainant can file a private complaint before concerned sessions court and the judge will either direct the police to register an FIR, complete the investigation and file the charge sheet or the judge can suo moto take cognizance of the offence and proceed further.
