नमस्कार सर, मी रोहिणी प्रकाश गांगुर्डे, येवला FIR १४०/२०२४ (Atrocity). Charge Sheet २४/०२/२०२५. आरोपींना Bombay HC interim bail (Cri.Appeal ७०५/२०२४). Bail मंजूर होताना victim ला हजर दिले नाही – कलम १५A(५) violation. Bombay HC मध्ये Bail Cancellation अर्ज (BNSS ४३९(२)+४८२) करायचा

हो, तुमच्या प्रकरणात Bail Cancellation साठी अर्ज करण्याचा पूर्ण कायदेशीर अधिकार आहे. जर आरोपींना अंतरिम जामीन देताना पीडित व्यक्तीला (victim) सुनावणीची संधी दिली नसेल, तर हे SC/ST Act च्या Section 15A(5) चे स्पष्ट उल्लंघन आहे. या तरतुदीनुसार पीडिताला bail hearing मध्ये ऐकले जाणे बंधनकारक आहे. त्यामुळे तुम्ही Bombay High Court मध्ये Bail Cancellation Application दाखल करू शकता

Bombay HC मध्ये BNSS कलम 439(2) सह 482 अंतर्गत Bail Cancellation अर्ज दाखल करा. Victim ला न कळवणे हे गंभीर उल्लंघन आहे. आदेश रद्द करून आरोपींची जामीन रद्द करण्याची मागणी करा. I hope, you got the due clarity.

Dear Rohini, granting bail without hearing the victim strictly violates Sec 15A(5) of the SC/ST Act. We must file a Bail Cancellation Application in the Bombay HC under BNSS 439(2) and 482. Please share the interim bail order to proceed
