Are 41(a) and Station Bail different? What is the station bail cost, and how does it relate to stati

17-Jul-2024 (In Criminal Law)
I received a 41(a) notice, and the police took money for station bail. Although I submitted a copy of my Aadhaar card, I didn't get any written confirmation that they granted me bail. The money was paid through my lawyer, who said that the bail bonds would be submitted in court and we wouldn't receive anything in writing. He also mentioned that my not being arrested itself is proof that I got bail. Please suggest what to do about the station bail cost and station bail 41(a).

In India, station bail (or police bail) refers to the release of an accused directly from the police station, usually for bailable offenses, without needing to approach a court. The cost isn?t a fixed amount it generally involves executing a personal bond, sometimes with or without sureties, and in rare cases, a small cash deposit depending on the nature of the offense and the officer's discretion. Unlike court bail, there are no standardized fees, but the process must comply with the provisions of the CrPC (Code of Criminal Procedure) to ensure it's legally valid.

Any person/s shown as accused in offence/s which is/are punishable for a term less than 7 years, won't be arrested. Just the SHO of the police station gives a notice to the accused under section 41-A Cr.P.C. that means a complaint lodged against you and you should attend before the concerned Court of law when you were asked so. The question of station Bail would not arose in police station. just they called you for giving notice only.
