Applicability of BNS / IPC for crime committed both before and after i

Various crime were committed by accused against me & my brother between 1ST OCT 2019 TO JAN 2025. The crimes are of alleged forgery, cheating, misappropriation, threatening in relation to a property. As on 1st July 2024 BNS was introduced. Now in my case crimes were committed by accused during both times that is before 1st July 2024 and after that. That is both Before and After of introduction of BNS ? Now in January 2025 I want to file and FIR should I be filing as per IPC or BNS ? Or both ?

If the incidence with you and the Accused has happened recently then the FIR will be registered under BNS and if the incidents are related to past incidents then the FIR will be registered under IPC. As of Now if the incidence with you and the Accused has occurred recently in January 2025 then on the basis of the current events with you and the Accused will be registered under BNS.

You can file the FIR under the Bharatiya Nyaya Sanhita (BNS) since it is now in effect as of July 1, 2024. The BNS replaces the IPC, and all offenses committed before or after its enactment can be prosecuted under its provisions as per transitional and procedural provisions. Clearly state the timelines and incidents while filing the complaint.

Whatever Offences or Crimes which have been committed against you before 1st July 2024, such committing of Crimes or Offences against you will be tried as per the CRPC, 2973 and whatever Crimes or Offences have been committed after 1st July 2024, then, such Offences or Crimes will be tried as per Bhartiya Nyaya Sanhita, 2023 and Bhartiya Suraksha Adhiniyam, 2023.
