Appeal for quashing of complaint by opposite party due to death.

My relative have filed a FIR against a person under section-IPC-323/504/506 for me as I was hurt. It was converted into private complaint by High court. My relative who has filed the FIR for me is dead now. The opposite party requested to quash the complaint as the person who filed the complained is dead now.Aggrieved person is me . my medical also done by doctor under police supervision. Please direct me what I should do to stop him from this.

Yes you can approach Hon'ble high court to quash the entire criminal proceeding along with the First Information Report. Your statement is little vague so i could reply only after knowing the whole case verbally, for the same you can whatsapp me or make a direct call to clear your query

Since you are the actual victim, the death of the relative who filed the FIR and who was pursuing the case does not affect the case's validity. You can always apprise the court about the situation. Additionally, you can place on record your medical reports and police documentation proving you were the aggrieved party. The High Court's conversion to a private complaint doesn't extinguish your right as the victim to pursue the case. You can oppose the quashing petition by demonstrating that you, as the actual victim, have the primary right to continue the prosecution, regardless of who initially reported the incident.
