Advocate not giving NOC in High Court

03-Nov-2025 (In Criminal Law)
I filed one petition in High Court. Till now he filed twice the petition and there are so many office objections. I paid him more than his fee amount nearly 50% extra. I am not satisfied with his service so i requested him for NOC. But he is intentionally harassing me like he is asking to come to collect NOC, after going to his suggested place, he use to wait me more than 3 hrs and not responding my calls and simply saying today not possible

you please ask him NOC if he is not giving NOC then No need to worry we can file a another petition with different cause of action as per the provisions of CPC. We cant continue with the same petition if there are no merits in the Matter!

Dear Sir, Submit an affidavit before the High Court stating that you are changing your advocate and the earlier counsel is not issuing NOC. The Court may then permit you to file a fresh Vakalatnama with a new advocate. Keep all payment receipts and communication records as evidence for any future action. Before doing that get issue a notice from your side to your Advocate to give NOC otherwise his power to represent you is terminated and you are at liberty to engage any other Advocate.

1. You have a full right to change your lawyer anytime. 2. Once fees are paid, the advocate must give NOC without delay. 3. Ask him to send NOC by email/WhatsApp or allow pickup. 4. Send a 24-hour written request for NOC. 5. If he refuses, file a memo in High Court and change counsel without NOC. 6. Keep all chats as proof and do not pay him more. 7. If harassment continues, complain to the State Bar Council for misconduct.
