Accident: Father serious injury, driver may be minor/unlicensed

24-Jun-2025 (In Criminal Law)
My father was seriously injured in a road accident on June 19. He was walking when a bike hit him from behind. His hip is broken, surgery cost ₹3.5L, and recovery will take 6+ months. The bike had heavy luggage and may have been driven by a minor or unlicensed person. No one from their side helped. Should I proceed legally through FIR and court? Will it give fair compensation or settlement? What is the best legal path to get justice and recover expenses?

I am very sorry to hear about your father's accident . Report the accident at the nearest police station and immediately file an FIR . The jury is especially serious and there are suspicions of the bike being driven by a minor . Follow as much evidence as possible. Immediately consult a lawyer and file a MACT claim for comprehensive compensation. Compensation can include 3.5 lakh of medical costs, loss of your father income, pain and suffering of your family. immediately take necessary action .

Yes, you should immediately file an FIR under relevant IPC sections such as 279 (rash driving), 337, 338 (causing hurt/grievous hurt by negligent act), and 304A if applicable. This will initiate a criminal case and help establish liability. Additionally, you can file a claim before the Motor Accident Claims Tribunal (MACT) to seek compensation for medical expenses, loss of income, and future care. If the bike was driven by a minor or unlicensed person, their guardian/owner can also be held liable. Legal action is your best route to ensure accountability and recover damages.
