5 years old relationship. Guy told girl his first wife is dead and he has a 4-5 years old daughter. The girl was ready to marry him and told about her serious relationship to her family. But the girl found out a month ago that the first wife is alive and the guy has 3 daughters, not one. He not only exploited the girl sexually but financially as well. He borrowed a lot of money from the girl on the pretext of his temporarily poor financial condition and false promise to marry, saying he will return everything one day together. Call recordings exist where the guy admits taking money and promising marriage to the girl. What is the best legal course for the girl to get her money back and to get justice? Also, what happens if she files section 376, the police goes to arrest the guy but he is not found at home? The girl has enquired about the guy's area, it is a very shitty place with no proper house no.s. Inter-state matter. What if the police fails to arrest the guy in the 1st attempt?

First of all, the girl should get the FIR registered without delay as it is a well settled law that delay in FIR is fatal to the case of prosecution. Even if the guy is not arrested he can be declared a proclaimed offender and when found it would be even more difficult for him to get the bail from court. If the police officials had already filed a FIR then they are duty bound and it’s police headache for the arrest of the accused. And if you have all the evidences of the transferred money then you can file a recovery suit before the civil court or forward a written complaint to the police station of your area to register a FIR under section 420. You must keep all evidences safely n don’t delete them from your phone n if you even happen to transfer then also don’t delete them from your phone ! Yes, it’s a case of cheating & modesty of women ! You need expert advocate to draft your complaint ! If he is not found at home court will issue warrants against him & he will be proclaimed offender too in case he during appear in the court ! Police will do their work ! Plz b in touch
