5 Lakh Cheating Case in real estate regarding [hosur].

Hi, A real estate guy, in the name of providing land, took an advance of 5Lakhs, and couldn't provide us land due to his misunderstanding with the land owner, when we asked for return he only gave partial amount of <1Lakh, and yet to give the remaining. Its been almost a year since this issue. My queries are,
1. How long does it take to resolve this issue if all the proofs are available against the real estate guy?.
2. I have banks statements, bill provided by him, recorded phone calls, on the 5Lakh advanced paid, is this proof sufficient enough to get justice?.

If he fails to comply with the statuary situation, you need to file a FIR against him that will lead to:
Charge criminal penalties against him, if you can prove that he lied to you and it all was intentional.
Charge him 18% p.a. interest on the non re payment of money from the day he promised to return to you.
Charge extra compensation money or extra legal cost, only if you raised a case against him in any court of India.
