To marry with a Minor is illegal in India, despite she & her family members giving her consent for it. Indulging in Sex with a Minor Girl amounts to Rape in India despite she & her family members giving consent for it.
However, if the Girl and/or family members of the Girl have not disclosed this information of Girl being a Minor & as such, they have manipulated the mind of the Boy/Man to marry such a Minor/indulge in performing sex on her/with her, then Bail is possible on this ground & as such, there are certain other grounds on which Bail can be procured & as such, the case of the Girl and her family members can get dismissed too

Sessions court can allow bail to accused if judge think fit to allow bail on conditions after filling of charge sheet therefore there is need of filing bail application before sessions court.Thereafter judge can pass appropriate orders.
