354 section FIR against unintentional abusing women

08-Nov-2023 (In Criminal Law)
We are constructing our house. My neighbour is a widow and she is arguing with us on window issue. We have 2 toilet windows one on each floor with no door to them. One day she provoked my mother saying when would your husband dies like mine and a abused children as well. She is shouting load and my mother is also arguing. Me and my brother inside our home and we came out due to that argument. Now she started abusing us also. When we went on road to talk infront of her home she started recording the video. She abused and we 3 also abused. Now with that video she filled FIR against my father (handicapped ), my mother, me and my brother using section 354 and other two sections. Also we not even touched her we didn't use weapons just arguments. Argument happened on the Street infront of her home as everyone watching. We don't have any intention to abuse her but she filed a case. So is it punishable offense?

hi yes they are punishable offences and you could file quash petition in high court stating that they are civil disputes pending with them and that you had not committed any offrnce and also defend the case on that point and need to see the other sections imposed also

Hello subject to the contents of your query, Yes it is a punishable non bailable offence, it is advisable for you to file an anticipatory bail application before the concerned court through your lawyer or else the police may arrest you and your family member based upon the FIR.
