Q: Cheque bounce case defence advice

My father used to run a medical shop 8 years ago. He took a loan from a private lender and gave my blank cheques as surety. Our shop was closed due to losses in 2017. I was doing a private job since 2010. Now the private lender has bounced my blank cheques in 2023 and filed a cheque bounce case against me, i.e. almost 7 years after he has lent the money to my father. Shall I fight the case as I did not take money directly from the lender and did not sign on any promissory note? or Shall I go for compromise as I stay in Mumbai and the case is filed in Hyderabad and it is difficult for me to travel every time for the hearing? He has filed 2 cases.. 1 cheque bounce and 2 cheating case(420). Please advice.

Hi, subject to the contents of your query, it is advisable for you to contest the above case as the cheques were blank and wasn't filled by you as such there is greater chance of success, as far as travelling to Hyderabad is concerned, you can skip the hearing by filling a petition to condone your absence each time you want to skip or approach Highcourt for permission to remain absent except few necessary hearings. Q: Face trial or approach the high court for quashing the chargesheet

I am facing an trial in accident case under sections 279 337 and 338 even though it is not my fault. Trial date is set and is about to begin in next 2 months. nWhen i got the chargesheet from court. I see there is lot of differences in witness statements and also even they created an fabricated witness which orated a complete different story related to how accident occurred. nNow I have to engage an advocate to face the trial which may take another 2 to 3 years and causes mental stress as i am a government servant. I saw few options over the internet and found cases are quashed in high court if the merits of chargesheet are challenged. n1. How reliable is this option? n2. Can i engage an advocate and put the chargesheet before the high court and quash it based on witness statements in chargesheet? n3. Should i face the trial in lower court for trial ? It takes another 2 to 3 years.? nPlease suggest on what is the best option as it is deciding factor for my career and family.

hello, subject to the contents of your query, it is advisable for you to approach the Hon'ble Highcourt to quash the chargesheet before proceeding to the trial and if the contents of chargesheet doesn't satisfy the section of law then there is a high probability that the Hon'ble Highcourt may quash the FIR or you can get an order to conduct speedy trial form Highcourt. Q: Hi this is my sister's Problem..... with husband and my mother in law

Hi I am married since 2019 April and I have a boy 2years old and my husband is...he is an alcoholic and a smoker and jobless....am doing job in a small company since 9months...he is torturing me mentally and asking my money every day...he is not giving any money since our marriage and not even for my child also ..I have to do all the house hold chores and go to job and when I come from Offc also I have to do all the chores....my mil also support his son and gives money for his drink...m not at all happy in this marriage..he is saying he will not do any job and he will be like this only...he scolds me if I will not give money to him..he evn not play or talk to my son also daily he will drink and smoke and evn infront mlof my son too...till now I adjusted that he will change but no I was wrong he is not going to change....he is so lazy and dirty...he himself not maintain him properly....am just a kaamvali Bhai in this house....o one talks to me properly not my mil my husband no one..

Q: succession & possession of inherited property issue.

My father died intestate in 2016. He had a self acquired house and land. My sister had a disturbance in her marriage and living with us in our home from past 9 years. I got married recently and work in a different place from my hometown. Now my mother and sister are not allowing us to enter my home. I want possession of my house according to my share. How can I fight and get my legal right. Also If the said above propoerties of my father were not divided yet, Can my mother write a will on my sister's name for what ever share she will get even with out dividing the propoerty.

Q: CANCELLATION OF FAMILY MEMBER CERTIFICATE

My father in law has two wifes and he has 3 daughters, first wife expired when my wife age was 4 months later my father in law got married her own sister. My father in law expired Mar 2020 due to algemra health issue they said. Later my wife went to vizag after covid. They applied family member certificate without my wife signature and supporting documents. Thahisldar rejected first time. Later my signed in application form and submitted then got family member certificate. What are the properties, Insurences and fixed deposits they withdraw without wife signature, later we applied what are documents they provide to apply family member certificate was asked in RTI, my mother in law mentioned my father in law has only one wife and my wise is also her daughter. Hence my wise approached spandana to cancel the Family member certificate due to wrong information provided. but thasidar is not accepted due to they recommended on government official not cancel. what can we do to cancel FMC
