Short counteraffidavit has been filed on behalf of the investigating agency by Sri Vikash Chandra Tripathi, Superintendent of Police, West, Lucknow. In the affidavit it has been stated that reinvestigation was undertaken. During the course of investigation, it has been found that victim of offence had given contradictory statements under Section 161 Cr.P.C., and Section 164 Cr.P.C. The statements were found not consistent with the F.I.R. version. Some of the allegations are found to be baseless. No evidence has been found to indicate commission of offence under Section 376D of the Indian Penal Code, therefore, the said offence was converted into Section 376 of the Indian Penal Code. Accordingly, investigation was conducted.

if such is the case and rape charges are false you may file a perjury case against her for lying on oath. kindly share the details of the case in order to give a more meaningful advice. apart from that a defamation case should also be filed against her immediately.
