304A Medical Negligence Ruling: Doctor's Absence

28-Aug-2024 (In Criminal Law)
A doctor performed a cesarean but patient died due to cardiac arrest on 3rd day. Doctor left town on 2nd day but was reachable by phone and suggested treatment. The patient was monitored by GNM staff and doctors unaffiliated to hospital. Despite no evidence of improper treatment found by the medical board, the court found the doctor negligent for not appointing another doctor in her absence. Was this ruling justified given her availability and the nursing staff's care?

The legal position is almost firmly established that where a patient dies due to the negligent medical treatment of the doctor, the doctor can be made liable in civil law for paying compensation and damages in tort and at the same time, if the degree of negligence is so gross and his act was reckless as to endanger the life of the patient, he would also be made criminally liable for offence under Section 304A of IPC.
