भारतीय दंड संहिता की धारा 409 के अनुसार, जो भी कोई लोक सेवक के नाते अथवा बैंक कर्मचारी, व्यापारी, फैक्टर, दलाल, अटर्नी या अभिकर्ता के रूप में किसी प्रकार की संपत्ति से जुड़ा हो या संपत्ति पर कोई भी प्रभुत्व होते हुए उस संपत्ति के विषय में विश्वास का आपराधिक हनन करता है, तो उसे किसी एक अवधि के लिए कारावास की सजा जिसे दस वर्ष तक बढ़ाया जा सकता है, और साथ ही आर्थिक दंड से दंडित किया जाएगा।
लागू अपराध
लोक सेवक या बैंक कर्मचारी, व्यापारी या अभिकर्ता द्वारा विश्वास का आपराधिक हनन
सजा - दस वर्ष कारावास और आर्थिक दंड।
यह एक गैर-जमानती, संज्ञेय अपराध है और प्रथम श्रेणी के मजिस्ट्रेट द्वारा विचारणीय है।
यह अपराध समझौता करने योग्य नहीं है।
अपराधसजासंज्ञेयजमानतविचारणीयलोक सेवक या बैंकर, व्यापारी या एजेंट आदि द्वारा विश्वास का आपराधिक उल्लंघनआजीवन कारावास या 10 साल + जुर्मानासंज्ञेयगैर जमानतीय
