120B, 419, 420 case registered in Delhi, we want to go for plea bagain

22-Apr-2023 (In Criminal Law)
Hello respected members,nSomeone I know got caught for impersonation in exam and an FIR is filed against him under section 419, 420, 120B. He was not impersonating, he paid someone to take exam on his behalf. Both are caught. We are thinking about going for plea bargain but as in this case, there is no victim as such. Is plea bargaining allowed in this case? If yes, is there any lawyer here who knows how to resolve issues like these? We need an advocate to proceed with plea bargaining, if allowed in these cases. FIR is registered in Delhi. Lawyer based in Delhi will be better.

helo sir Any accused person above the age of 18 years and against whom a trial is pending, can file an application for plea bargaining. But, there are some exceptions to this general rule. The offence against the accused should carry a maximum sentence of less than 7 years.
so in your case punishment is less than 7 years you are eligible for ple bargaing. for further detail contact us u will get perfect positive result.

Plea bargaining is a pre-trial negotiation between the accused and the prosecution where the accused agrees to plead guilty in exchange for certain concessions by the prosecution. It is a bargain wherein a defendant pleads responsible to a lesser fee and the prosecutors in go backdrop more serious charges. Ultimately, the plea bargaining leads to the conviction which can affect the future of the child. Better way is, even if the person has been caught impersonating but the mens rea of the offense can be put to test and the case can be defended and when the guilt can not be proved beyond reasonable doubt, the court can not convict and it will lead to the acquittal
