Want to know if the below clause is valid as per the Indian penal code

The services shall be terminated by either the Employee or from the company as per below terms a. If the termination initiated by the company, it has the entitlement of either giving 90 days notice or pay the salary in lieu of the notice period or for any less period as decided by the company b. if the termination is initiated by the employee, serving of 90 days notice is mandatory to enable smooth transition and knowledge transfer. No payment will be accepted from the Employee under any circumstances in lieu of the Notice period. c. On the event of you failing to adhere the above clause and fail to give 90 days notice you will be liable for any disciplinary and legal action as found deemed fit by the company and also not be eligible for any relieving documents. I want to get relived in 30 days so want to know if this clause falls under IPC or not. How do you suggest i should get relieved without any hassles.

Firstly talk to the HR manager to relive you at the earliest if they fail to relive you send legal notice. Need to see your agreement before further commenting or guidance. IPC is seperate thing not applicable to your case. Feel free to contact me for further guidance if you need

See you are bound by company policies. check your offer letter and read the terms and conditions then you can understand whether you have done any violations as alleged by your company. If not then contact us we can file case against company before labour commissioner. You dnt need to worry about IPC it's not relevant here
