should an Indian company comply with GDPR if some users are from EU

09-Jul-2023 (In Corporate Law)
To what extent should an Indian company not providing services directly to the EU comply with the GDPR if some of its users (of various nationalities travel to the EU)? As GDPR compliance is necessary for processing data belonging to EU residents and the term residents has not been defined.

Generally all companies processing data belonging to EU have to comply with GDPR Regulations. However, certain companies are provided with some exceptions. One thing that has to be kept in mind before going for exceptions is that, even if you collect and store EU Data then you have to comply with GDPR Regulations, regardless of you being handling it directly or indirectly through another company. The exceptions provided are for a MSMEs with less than 250 employees as mentioned in Art 30 of GDPR. This exception however, would not be provided if the data being handled is a risk to security.
