Registered address issue and business conduct area issue

30-Aug-2023 (In Corporate Law)
Hello Sir, I have a query. I have civil suite filed in court against a startup company. The got companies court certified copies of MOA and AOA documents and used the registered address mentioned there to file the suit. However the company has asked for rejection of the plaint on the basis that their address mentioned in MCA master data is different. My question is, in case of registered office address discrepancy between MoA/AoA vs MCA master data, which address is considered valid.

the rejection of plaint on the basis of different addresses mentioned on the MCA portal cannot be a ground.
There can be a lot of reasons for different addresses mentioned on the portal or on MOA & AOA.

Dear sir, in MOA only State in which the registered address will be situated is mentioned. However, the proper address with full disclosure is only mentioned in the Master Data or say Form INC-22 (earlier Form 18). The company is right in their contention that MCA Master Data is only valid for purpose of deciding jurisdiction in civil suit so better you check the Company's Master Data first then file a suit or withdraw the present suit and file with appropriate court.
